# Robby penalized for rear axle: NASCAR has issued penalties to the #7 team that competes in the NASCAR Sprint Cup Series as a result of rules violations committed at Lowe’s Motor Speedway earlier this week. The #7 car, driven and owned by Robby Gordon, was found to be in violation of Sections 12-1 (actions detrimental to stock car racing); 12-4I (any determination by NASCAR Officials that the race equipment used in the event does not conform to NASCAR rules); and 20-10.6H (rear axle housing exceeded the maximum specified toe of plus or minus one degree) of the 2009 NASCAR Sprint Cup Series Rule Book. The violation was found during post-race inspection on May 25. As a result, Gordon has been penalized with the loss of 50 championship owner and 50 championship driver points. Crew chief Kirk Almquist has been fined $50,000 and placed on NASCAR probation until Dec. 31.(NASCAR PR)(5-27-2009)

He can make this up. I remember when Gene was the crew chief, at one race the car had a missing camera mount - that resulted in a 25-point penalty.
Also, in the wake of NASCAR dropping the sledgehammer on Carl Long, the reaction on the forums I have seen are almost 100 percent in support or Robby.
Maybe he should appeal this thing. What does he have to lose?

The appeals board can increase the penalty, so you don't want to wast thier time. If the part was truly out of spec - on purpose or by accident - then there's no benefit in trying to appeal it.
The only way it would make sense to appeal would be if they are absolutely sure the part was within specs, and they suspect a bad measurment by NASCAR, or if the variance might have been caused by something that happened on the track.
Unless we hear more details, this doesn't sound like something worth appealing.

This couldn't have come at a better time given the ongoing criticism NASCAR is getting with the Mayfield and Long suspensions and penalties. NASCAR needed to show they're not against the little guy and with RGM being the only single car team in the top 35, they went light on him - a wrist slap.

You make a good point, Looking back on Jayski's penalties page, the only penalty less than 100 points was Ryan Newman's 25-point penalty after his car was too high.

Is this Nascar's way of getting RGM back for finishing 3rd this past weekend? first Robby dosn't even get in to the top 10 in all star votes, and now wow he is gets a penalty. Is this the first race RGM used this set up? That we will never know, and understand why but this does make me scratch my chin and go hmmmmmm. any one else?

I'd be willing to bet quite a bit that they find more than plus/minus one degree of toe in Tony Stewart, Jimmie Johnson, Carl Edwards, et al every single week...it's just the microscope isn't as big on the big-money teams

My guess is RGM read the rules and decided 1 degree + 1 degree = 2 degrees. That means we can toe one side 2 degrees and leave the other side at 0 and be legal. =P
I am not a racing engineer and have no idea why anyone would want to do that, but thats my best guess at how you could see this as a gray area,
